This paper investigates whether and to what extent there is a conflict of interest between artists and their publishers, regarding to whether and to what degree illegal distributions of their copyrighted recordings should be prevented. This conflict arises because artists also earn their profit from other market activities such as giving live performances, in addition to their share of profits from sales of their copyrighted recordings via the publishers.  相似文献

We examine the potential benefits of product piracy to entrepreneurial firms. Specifically, we use a resource-based perspective to show that a decrease in the inimitability of an entrepreneurial firm's intellectual property does not necessarily diminish performance when piracy increases the value of this resource, and an information economics perspective to explain why and when imitation can increase the value of an intellectual property resource. This explanation reconciles empirical studies that indicate mixed results. It also expands the resource-based view by suggesting that reducing the value of one resource can directly increase the value of another.  相似文献

This paper examines the relationship between the rate of software diffusion and piracy. Literature suggests that tolerating some piracy can be justified since it speeds up software diffusion. The question is, how much should be tolerated? Using innovation diffusion models of software adoption by legal buyers and pirates, answers to this question are obtained for the three scenarios of monopoly, multiple generations of software and competitive markets. Results include, for example, that a monopoly should start with minimum protection of its software but well before the product has diffused half way, impose maximum protection and maintain it thereafter. The results provide important strategic guidelines for firms in the software industry for managing piracy.  相似文献

There is substantial interconnection between the reduction of product counterfeiting and quality management. This article seeks to demonstrate how integrating anti-counterfeiting initiatives into quality management strategies can reduce risk in the supply chain. We explore issues pertaining to product counterfeiting, the practical application and constraints of anti-counterfeiting initiatives within the supply chain, and the intersection of anti-counterfeiting initiatives with quality management programs. Gaps in current management strategies to address these issues are identified, and a potential remedy to address these deficiencies is proposed. Practical suggestions regarding the application of quality principles to offset counterfeiting should reduce risk in the supply chain.  相似文献

We review strategies that movie distributors have used to cope with piracy, copying, and sharing of movies in the United States in four categories: “hard goods” commercial piracy, consumer theft of pay TV signals, consumer copying and sharing of videos and pay TV, and (mostly in prospect) Internet file sharing. In the past, distributors have mainly sought to raise costs of engaging in these activities by increasing legal jeopardy, advantaging anti-copy technology, and reducing original sources of supply. They appear to have effectively reduced or contained most piracy, copying, and sharing of movies in the U.S., at least with analog media. Movie distributors are following similar strategies with digital media, including Internet file sharing. Digital media raise the stakes because of lower costs of copying or sharing and higher quality of outputs. Digital outputs are not always as high quality as source originals, however, and digital rights management (DRM) technologies potentially improve distributor control. The movie studios now face technological, demand, and political uncertainties in the U.S., notably in maintaining or achieving technically compatible DRM systems to control file sharing and PPV/VOD copying. One unique feature of the emerging economies in Asia is the rich variation in the development of financial systems and technological sectors across different geographical areas. This unbalanced evolution provides us a potentially more powerful setting to investigate the dynamics among banking systems, innovations, intellectual property (IP) protections, and stock market reactions that are especially useful in understanding the policy–finance–innovation nexus in emerging economies. Using newly available data from China, this study confirms the nurturing role of financial systems on innovations, the value-enhancing function of firms' innovative activities, and the lead–lag predictive role of innovations on stock returns, in the context of emerging economies. More importantly, the study documents that stronger provincial IP protections reduce patent piracy and hence enhance local firms' market values.  相似文献

In a global marketplace, doing business in China is inevitable. Companies that conduct business in China, especially manufacturing and distribution, are particularly sensitive to piracy. It is common knowledge that piracy can be found everywhere in China, and in virtually every industry. This article analyzes Intellectual Property Rights and the business structure in China. Herein, the legal system is evaluated and common problems facing companies operating in China are discussed. We conclude with suggestions for companies currently operating in China, as well as those which plan to enter China in the near future. The opportunities of doing business in China outweigh the threat and fear of piracy.  相似文献

本文是对中国年轻的专利制度的经济学分析。通过一个包含假冒生产行为的理论模型和相应的计量检验 ,我们研究了中国普遍存在的假冒生产活动对专利保护的影响 ,并得出结论 :中国 1 993年以延长专利保护时间为主的专利法修改未使地区专利申请和研究开发投入的倾向上升 ,反而有所下降 ,原因在于专利保护时间的延长刺激了更多的假冒企业进入那些具有较大假冒潜力的行业 ,从而专利开发企业的利益受到了损害 ,也就没有动力进行进一步的研究开发和专利申请。对一切行业实行相同的专利保护期T与相同的惩罚假冒力度K ,必定违反最优专利制度设计原则。应该针对不同行业的假冒生产特点 ,通过制定相应的法律政策使假冒潜力最大的行业假冒成本提高。另外 ,就当前关于计算机软件保护的争论 ,本文认为软件行业过去保护不足。  相似文献
