公共秩序保留作为国际私法的一种特殊制度,其实质是用来保护本国的国家利益,从而拒绝外国法的适用或者拒绝承认与执行外国法院判决或外国仲裁裁决,因而被称为保护本国利益的“安全阀”。虽然各国对该制度理解不一,但都在立法上对它进行了规定。晚近,各国国际私法对公共秩序保留的态度出现了不同程度的改变,公共秩序保留开始出现式微的发展趋势。这种趋势的出现,除了其本身的缺陷外,主要是全球化的影响以及法律趋同化的演变。 相似文献

Using data gained from ethnographic research and interviews, this article examines ‘third place’ sociability in the social interactions of the Polar Bears of Martha’s Vineyard, a group of predominantly but not exclusively middle-aged and senior African-American men and women who swim, exercise and socialise together each morning at ‘the Inkwell’ beach. Using Georg Simmel’s concept of sociability and Ray Oldenburg’s third-place theoretical framework, this study explores the key role of the Monday communal breakfast and the function of conversation in establishing bonds between individuals. It further investigates the promotion of strong feelings of social connectedness, belonging, social support, social capital gains and community among its group members. The ongoing sociability and informal rules of the Polar Bears of Martha’s Vineyard has enabled it to become a model group demonstration of third-place community building. The importance of race, class and place is socio-historically investigated within the broader social context of the popular racialised section of the beach, ‘the Inkwell’, of African-American community life, and within the sub-community milieu of group social interaction. 相似文献

Abstract This study investigated the effects of subculture, marginality, and perceived discrimination on use of selected public outdoor recreation areas. The assimilation perspective from the sociology literature provided theoretical guidance for the study. These concepts were treated as different types of social distance (cultural distance, socioeconomic distance, and intergroup distance). Each was hypothesized to affect the use of outdoor recreation areas. Data for this analysis came from telephone interviews conducted with 1057 households in Maricopa and Gila counties in Arizona. The analysis was conducted using a subsample of respondents of Mexican ancestry. The results support the socioeconomic, or marginality, hypothesis. There was less support for the subcultural, or ethnicity, hypothesis. There was no support for the perceived discrimination hypothesis. Research implications and recommendations are discussed. 相似文献

Links between the reputation of organizations and their financial performance are intuitively attractive to assume, but often difficult to demonstrate convincingly. Gaps between employee and customer perceptions of corporate reputation have traditionally been associated with poor performance. In the context of service business and applying assimilation‐contrast theory, we hypothesize that the nature of such gaps will, in reality, have a differential effect on future revenue depending on the size and valence of the gap. The effects of small gaps should be assimilated by customers, but larger ones have a greater potential of creating a contrast effect resulting in significant increases or decreases in subsequent sales. In businesses where employees have a more positive view of the company reputation than customers, we hypothesize a growth in future sales, and where they have a relatively more negative view, a decline. We test the effects of what we label as reputation gaps in 56 business units drawn from nine service organizations and confirm our hypotheses. Among the implications of our findings are that managing reputation by elevating employee perceptions of a company's reputation above those perceived by its customers holds the potential to enhance future sales. We examine how US immigrants would be affected by applying a simple point system for admission, as Canada does. Since US immigration policy emphasizes family reunification, immigrants have lower education and earnings than natives, with unauthorized immigrants’ education below legal ones. Using American Community Survey data, and Center for Migration Studies data, which allows us to distinguish legal from unauthorized immigrants, we examine the effects of requiring immigrants to meet 2 of 3 conditions: (1) a high school or college degree, (2) being less than 40 years old and (3) working in a professional occupation, while admitting the same numbers of immigrants. This policy changes the source countries of immigrants and there are large positive effects on immigrant earnings. Immigrants’ use of government transfer programs is reduced to below natives and income inequality falls. Finally, with existing policy, immigrant earnings growth is not enough to overtake natives given immigrants’ entering earnings disadvantage. With this point system, immigrants start at a higher level and surpass natives relatively quickly. 相似文献

Prior research mentions that there may be technology assimilation gaps in that a technology may be cumulatively assimilated over a period of time depending on knowledge and experience from initial usage. Thus, stages of partial assimilation are indicated that, if not accounted for, could lead to erroneous understanding of technology adoption and diffusion. However, the phenomenon has not received serious academic attention, and there is still a lack of understanding as to when and why partial assimilation may occur, its consequences to organizations, and remedial steps that could be taken to minimize it. We investigate these issues in the context of assimilation of third-party business-to-business (B2B) e-market by four small firms. Our findings reveal that partial assimilation occurred because of different perceptions of benefit and risk of the two different features of the B2B e-market—the informational (buyer/supplier and product information) and the transactional (auction, request for quote, price negotiation, message archiving, payment systems), arising from different moderating impacts of the organizational (relational norms and the type of business handled) and environmental (perceptions of competitive pressure and institutional norms of technology usage and work practices) contexts of deployment and usage of the two features. The consequences of partial assimilation were mixed; while it was found to be detrimental to firms with low relational norms with their clients, it proved to be gainful for firms with high relational norms. Theoretical and practical implications of the findings are discussed. 相似文献

Recent operations management and innovation management research emphasizes the importance of supplier integration. However, the empirical results as to the relationship between supplier integration and time-to-market are ambivalent. To understand this important relationship, we incorporate two major recent developments. First, the literature has started to redefine supplier integration into two dimensions, supplier product integration and supplier process integration. Second, recent research has begun to examine spillover effects that extend beyond the direct costs and benefits of the supplier contract. Using survey data of 116 firms in the industrials, health care, and information technology industries, the results confirm our hypotheses and show that supplier product integration decelerates time-to-market while supplier process integration accelerates time-to-market. The results also show a positive relationship between supplier integration and the adoption of external technologies, which either decelerates or accelerates time-to-market depending on the level of internal exploration activities. Our research, thus, helps to open the ‘black-box’ of the relationship between supplier integration and time-to-market, and provides a theoretically grounded explanation to the apparent contradictory results in prior research about the influence of supplier integration on time-to-market. In addition, we contribute to research on spillover effects by emphasizing that information technology adoption and assimilation is an important spillover effect of supplier integration. 相似文献
