文章分析了热门影片《非诚勿扰》对同性恋的再现。通过对过去三十年同性恋题材一主要是男同性恋题材——的华语电影的发展进行一个简要的梳理,文章把影片关于同性恋的再现纳入一个不断变迁,映照社会政治和反思文化传统的话语体系之中。本文对这部影片相关剧情展开了细致的文本分析,围绕的中心问题是同性恋再现的公共性是如何在审查权威的监控下得以实现的。结合影片上映后引发的各方争论,尤其是来自同性恋社区和运动积极分子的反应,文章最后讨论了同性恋电影对当代中国同性恋社群争取公共空间,提升社会可见度,并最终实现平等权利的意义。  相似文献

This paper addresses the criticism recently directed at Internet companies who have chosen to do business in China. Currently, in order to conduct business in China, companies must agree to the Chinese government’s rule of self-censoring any information the government deems inappropriate. We start by explaining how some of these companies have violated the human rights of Chinese citizens to freely trade information. We then analyze whether the justifications and excuses offered by these companies are sufficient to absolve them of moral responsibility. We argue that both justifications and excuses offered are insufficient. Wilfully abiding by unjust laws, albeit necessary to do business in China, should not trump moral actions that protect rights. “This is not something we did enthusiastically, or not something that we are proud of at all.”– Elliot Schrage answering questions from Congress regarding Google’s decision to censor its Internet searches in China Neil Haddow is currently finishing his PhD in philosophy at the University of Waterloo. 因WTO的贸易自由化宗旨及历史原因,WTO的现行规则未因电影产品的文化和经济属性对其内容审查制度存有“特殊待遇”条款。WTO成员既不能以电影的文化性采取贸易限制措施,也无法有效适用“公共道德”例外条款证明其违反相关贸易承诺的正当性。为履行“入世”承诺,中国唯有在国内层面上经过适当的法律协调,国际层面上相关成员方共同的长期努力,才能使电影的文化性、服务性受到重视,享有相应的特别待遇。  相似文献

A short t of a one dimensional probability distribution is defined to be an interval which has at least probability t and minimal length. The length of a show and its obvious estimator are significant measures of scale of a distribution and the corresponding random sample, respectively. In this note a non-parametric asymptotic confidence interval for the length of the (uniqueness is assumed) short t is established in the random censorship from the right model. The estimator of the length of the short t is based on the product-limit (PL) estimator of the unknown distribution function. The proof of the result mainly follows from an appropriate combination of the Glivenko-Cantelli theorem and the functional central limit theorem for the PL estimator.  相似文献

Internet censorship and control have been commonplace in Tunisia since the Internet became available to then public in 1996. It was not until the last days of the Jasmine revolution in January 2011 that the Tunisian government shut down the censorship regime, raising numerous questions about Internet censorship in Tunisia. This article will look at how former Tunisian president Ben Ali was able to shut down the Internet censorship regime within a matter of hours. In order to answer this question, it looks at the history of the Tunisian Internet and its Internet censorship regime, before analysing Internet architecture, Internet institutions, functional differentiation between elements of the regime and the role of international technology markets. Each of these factors contributes to the overall censorship regime and helps understand how former President Ben Ali was able to shutdown Internet censorship within a matter of hours. In conclusion, tracing the genesis of the Tunisian censorship regime may contribute to understanding the role of institutional, architectural and market-based factors in enabling other censorship regimes across the world.  相似文献

预告片本质上是电影广告,这是美国预告片检查制度得以建立的必要性与合法性所在。作为电影广告,预告片在很大程度上能够影响电影票房收入。为了吸引观众,预告片以性、色情、暴力、吸毒等内容为主要叙事元素,引发政府与压力集团的谴责与反对,催生出美国预告片检查制度。这种检查制度建立于古典好莱坞时期,历经新好莱坞时期并延续至今。预告片检查的合法性基础在于预告片是不受《第一修正案》完全保护的商业表达。但是,随着制作艺术与技术的提升,预告片逐渐成为兼具商业性与艺术性的混合表达,预告片检查制度的合法性面临挑战。  相似文献

美国对华投资保护逐渐加强,并呈现出新表现和新特点。美国对华投资保护政策转变的原因包括:美国通过遏制中国的科技创新能力来巩固其全球科技领导地位;美国各界对"中国崛起"达成新的共识;美国对中国对外投资规模和投资模式的担忧;"非对称"和"非互惠"的双边投资准入政策等等。除此之外,美国对华投资保护政策存在以下影响:未来双边或多边投资框架协定可能会朝着更加有利于"美国优先"的方向发展;美国对华投资保护的不断升级或将产生连锁反应;美国将重点打压中国高端制造业和技术密集型产业投资;美国通过重塑和强化以美国为主导的全球价值链阻碍中国向价值链高端攀升。  相似文献
