专利技术转让的产权关系研究

随着科学技术的不断创新和提高,专利技术的交易越来越频繁,其交易所占贸易的比重也越来越大。文章指出,在专利技术交易发生前后对被交易技术进行必要的产权研究,理顺交易双方的产权关系,明确交易双方的权利和义务,对于交易双方避免交易错位和发生法律纠纷有着重要的指导意义。

Overcoming localization of knowledge — the role of professional service firms

The literature on organizational learning asserts that external learning is often limited geographically and technologically. We scrutinize to what extent organizations acquire external knowledge by accessing external knowledge repositories. We argue that professional service firms (PSFs) grant access to nonlocalized knowledge repositories and thereby not only facilitate external learning but also help to overcome localization. Focusing on patent law firms, we test our predictions using a unique dataset of 544,820 pairs of European patent applications. Analyzing patterns of knowledge flows captured in patent citations, we find that accessing a PSF's repository facilitates the acquisition of external knowledge. As the effect is more pronounced for knowledge that is distant to a focal organization, we conclude that having access to a knowledge repository compensates for localization disadvantages. How knowledge flow affects Korean ICT manufacturing firm performance: a focus on open innovation strategy

The paper presents an integrated viewpoint of technological innovation strategy by considering both the firm and industry levels. Further, we provide a new open innovation framework by adopting a knowledge flow perspective using patent citation information. Finally, we consider a firm’s outbound open innovation performance using cites per patent information together with financial performance to look at both the practical and the potential effects of technological innovation strategy. Through these analyses, this study examines determinants of open technology innovation activity in the information and communication technology manufacturing industry in Korea and draws managerial and policy implications for effective industry promotion and improvement of technology innovation capability.     

专利视角下的中国转基因小麦研究现状及发展分析

利用"智慧芽"数据库对我国1997-2018年间的转基因小麦专利文件进行统计分析,从申请趋势、IPC分类、核心专利分析等层面得出转基因小麦技术发展趋势,从专利角度分析目前我国研究机构所面临的问题并提出专利布局的思路。     

Embracing invention similarity for the measurement of vertically overlapping claims

ABSTRACT

Clear and well-defined patent rights can incentivize innovation by granting monopoly rights to the inventor for a limited period of time in exchange for public disclosure of the invention. However, with cumulative innovation, when a product draws from intellectual property held across multiple firms (including fragmented intellectual property or patent thickets), contracting failures may lead to suboptimal economic outcomes. However, an alternative theory, developed by a variety of scholars, contends that patent thickets have a more ambiguous effect. Researchers have developed several measures to gauge the extent and impact of cumulative innovation and the various channels of patent thickets. This paper contends that mis-measurement may contribute to the incoherence and overall lack of consensus within the patent thickets literature. Specifically, the literature is missing a precise measure of vertically overlapping claims. We propose a new measure of vertically overlapping claims that incorporates invention similarity to more precisely identify inventive overlap. The measure defined in this paper will enable more accurate measurement, and allow for novel economic research on cumulative innovation, fragmentation in intellectual property, and patent thickets within and across all patent jurisdictions.     

Policy Instruments,Patents, and International Technology Diffusion in a North-South Duopoly

This article analyzes the relationship between policy instruments and technology diffusion in a North-South duopoly within an inter-temporal model. The North benefits from a monopoly period with a new technology. At the end, there is then technology diffusion from the North to the South. The Northern firm files a patent in order to slow down the diffusion. This article studies the impact of several policy instruments. The results show that the Northern government’s policy instruments slow down technology diffusion, except for an import quota. The Southern government’s policy instruments accelerate the new technology diffusion.
