专利技术转让的产权关系研究

随着科学技术的不断创新和提高,专利技术的交易越来越频繁,其交易所占贸易的比重也越来越大。文章指出,在专利技术交易发生前后对被交易技术进行必要的产权研究,理顺交易双方的产权关系,明确交易双方的权利和义务,对于交易双方避免交易错位和发生法律纠纷有着重要的指导意义。     

Squatting as a transition problem in South Africa

This paper applies principles of transition to land tenure and squatting in South Africa. Political transition in South Africa reassigned political property rights, which produced contestable, and rent‐seeking incentives for squatting as a means to privatize land and redistribute wealth. Government failure to establish and protect private property rights in a squatter camp resulted in common‐pool problems that resisted private and public resolution with consequent rent dissipation and social loss. In response to this retreat from duty, informal agents emerged to claim their own share of the prize. Without enforceable rules of capture, the growth of squatter camps in South Africa will continue. Intergovernmental transfers and fiscal behavior insurance versus aggregate discipline

This paper evaluates the trade-off between the advantages of risk sharing and the perils of common pool problems in federal fiscal arrangements. Under the assumption of asymmetric information we evaluate two alternative regimes of intergovernmental transfers. In one regime, the central government pre-commits to a certain level of transfers that compensate vertical fiscal imbalances and provide some limited ex-ante insurance. In the other regime, it accommodates ex-post the fiscal needs of the different provinces. In this second case, full-insurance results, but the economy is subject to a tragedy of the fiscal commons, with excessive subnational spending, insufficient local taxation, and reduced production of federal public goods. We find the range of parameters for which one or the other institutional regime will be preferable. The result is a fiscal-federalism version of the usual trade-off between rules and discretion.

把我国现有知识产权制度与环境保护现状有机地结合起来,针对性地研究了两者的相关性,系统、全面地分析了我国现有知识产权制度对环境保护的影响,指出了现有知识产权制度与环境保护实施不协调的若干具体问题,并就此提出了建设性意见及对策.     

Common pool resources and contextual factors: Evolution of a fishermen's cooperative in Calcutta

The CPR school has successfully rebutted Hardin's pessimistic Tragedy of the Commons model. However, in recent years, critics have focussed on the inward orientation and lack of contextual analysis characterising the writings of the CPR school.Oakerson [A Model for the analysis of common property problems. Working Paper R86-13. Workshop in Political Theory and Policy Analysis, Indiana University, 1986] and Ostrom [Governing the Commons. Cambridge, Cambridge University Press, 1990] have detailed the list of variables that have to be studied to understand the mechanics of collective action. However, these factors are internal to the community. Recent critics' point out that the actions of individual agents are also influenced by the alternatives embedded outside the system. These variables are collectively labelled contextual factors.In our paper, we have analysed the case of a fishermen's cooperative in the Calcutta Metropolitan District to show how the historic and economic context shapes targets of resource users and affects the feasibility of alternative courses to achieve the target by determining opportunity and transaction costs of actions. This indicates the importance of contextual factors in explaining the formation and evolution of the resource regime.     

A Common Pool Resource Game with Sequential Decisions and Experimental Evidence

We describe a common pool resource game in which players choose how much of the stock to extract in a sequential manner. There are two choices and one represents taking a larger proportion of the stock than the other. After a player makes a choice, the remaining stock grows at a constant rate. We consider a game with a finite number of alternating moves. It is shown that changes in the larger proportion of the stock that the players are allowed to take and the growth rate affect equilibrium, but have little effect on behavior in the laboratory. In addition to observing more cooperation than predicted, we observe that parameters that are strategically irrelevant affect behavior. The results of this research might help policy makers in developing adequate policies to prevent overexploitation of some natural renewable resources.

本文概述了第三方物流的理论基础及国内外对第三方物流的研究现状，并在此基础上提出了国内外对此研究存在的问题。     

高管海外背景与企业专利国际化 ——基于P CT申请的经验证据

在当前我国PCT(《专利合作条约》)国际专利申请(以下简称PCT申请)快速增长的背景下,本文使用2009~2019年创业板企业的数据,实证分析了高管海外背景对企业专利国际化的影响效果。研究发现:高管海外背景会正向促进企业专利国际化,且当高管既有海外求学背景又有海外任职背景时促进作用最强;相较于非CEO高管海外背景,CEO海外背景更能促进企业专利国际化;从内部治理因素看,高管股票期权激励正向调节高管海外背景对企业专利国际化的促进作用;从外部治理因素看,在知识产权保护程度低的地区,高管海外背景对企业专利国际化的推动作用更明显。本文的研究拓宽了国际专利申请的影响因素以及高管海外背景领域的相关文献,对企业开拓国际市场实现专利国际化具有指导意义。
