浅论我国农村环境的法律体系建设

本文分析了我国农村环境法律体系在立法、执法等方面存在的问题,据此提出了健全和完善农村环保法制的一些设想。

从集合列的定义出发,系统总结并讨论了集合列的上(下)极限的一般性质。分别在广义实值函数空间和一般模糊测度空间上,利用集合列的上(下)极限定义和性质,研究了广义实值函数和一般模糊测度的表示和应用问题。     

消费税制的国际比较及其对我国的启示

消费税制改革是我国新一轮税制改革的任务之一。改革和完善我国消费税制，应借鉴国外一些成功经验，丰富和完善我国消费税的立法原则，适当扩大征税范围，调整税收负担，改革计税依据和征税方法。     

Legislative Bargaining and Coalition Formation

The finite horizon version of D. P. Baron and J. Ferejohn's [1989, Amer. Polit. Sci. Rev.83, 1181-1206] legislative bargaining model is investigated. With three or more periods, a continuum of divisions is supportable as subgame perfect equilib- ria. There exist equilibria where coalitions larger than a minimal winning coalition receive strictly positive shares. With sufficiently patient players and a sufficiently long horizon, any interior distribution is supportable as an equilibrium. In contrast, a generic uniqueness result applies when introducing heterogenous time preferences. The unique backwards induction equilibrium in the perturbed game is nonstationary, and neither the original (symmetric) nor the perturbed game provides guidance for equilibrium selection in the infinite game. 制约我国中小企业自主创新的法律因素及立法建议

改革开放以来，我国中小企业数量激增，涉及行业不断扩大，同时现行法律法规中对中小企业自主创新的诸多制约因素也日益凸现。剔除这些制约因素，构建一个和谐的法律支撑体系，是我国中小企业可持续、健康快速发展的保证。     

ETF Premiums and Liquidity Segmentation

Exchange traded funds (ETFs) provide a means for investors to access assets indirectly that may be accessible at a high cost otherwise. I show that liquidity segmentation can explain the tendency for ETFs to trade at a premium to net asset value (NAV) as well as the life‐cycle pattern in premiums. ETFs with larger NAV tracking error standard deviations (TESDs) tend to trade at higher premiums and the liquidity benefits offered by foreign ETFs and fixed income ETFs are revealed to be the most valuable to investors. Further tests validate that TESD has the desirable properties of a liquidity segmentation measure.     

试论强化我国地理标志的法律保护——以法国香槟酒行业委员会与商标评审委员会商标争议纠纷为引

随着经济的发展,人们越来越重视地理标志在市场竞争中的作用。各国均在法律层面对地理标志予以保护,并采用不同的立法模式。我国表现为结合运用《商标法》和《地理标志产品保护规定》来保护地理标志。但从实践来看,此种方式尚存在缺陷。在最新修订的《商标法》中也没有提出将地理标志区分于其他标志而给予针对性的规定。为了进一步发挥其在国际竞争中的经济价值,我国应当给予地理标志更大力度的保护。

挑战极限户外旅游是一种新兴的旅游发展方向,它可以满足人们寻求刺激和放松身心的需要。通过对青海省发展极限旅游的条件分析,认为青海省可以在登山、攀岩、漂流、自行车赛、汽车拉力赛、徒步探险等十一个项目开展极限探险旅游活动,对推动当地旅游发展潜力巨大。     

大数据对法院司法统计的积极功效及边界

最高人民法院于2016年应用人民法院大数据管理和服务平台以后,全国法院司法统计完全实现计算机自动采集。从发展脉络来看法院司法统计正处于智能化转型阶段,仍然存在一些问题。随着大数据及新技术的引入,司法统计“大数据”得以成为现实,包括了数据采集的全面化、统计分析的综合化、统计平台的社会化,进而提出了大数据助力司法统计精准化的具体路径,包括了提高基础数据的量与质、加强对司法统计数据的深度分析和可视化分析、推进基础设施建设。然而,二者并不具有正相关性。因此,推进司法统计大数据化需要注意有两个限度。     

The untold story of commodity futures in China

We investigate the behavior of commodity futures risk premia in China. In the presence of retail-dominance and barriers-to-entry, the term structure and momentum premia remain persistent, whereas hedging pressure, skewness, volatility, and liquidity premia are distorted by time-varying margins and strict position limits. Furthermore, open interest, currency, and inflation premia are sensitive to institutional settings. The observed premia cannot be attributed to common risks, sentiment, transactions costs, or data-snooping, but are related to liquidity, anchoring, and regulation-induced limits-to-arbitrage. We highlight the distinctive features of Chinese futures markets and assess the challenges posed to theories of commodity risk premia.
