论关天经济区地方立法协作制度的构建

为了保证关天经济区经济一体化的快速发展,经济区地方法协立法应该成为建设关天经济区重要的法制基础。目前,在实施过程中,关天经济区协作立法正遇到立法体制上的缺陷、立法实践中的不足、立法理论上的争议等困境。它们都极大地阻碍了关天经济区经济一体化的有效发展。文章通过对关天经济区立法现状、立法原则、立法模式、立法事项等分析,得出结论,必须从建立统一的地方协作立法体系,建立经济区内各地的执法协作机制,建立经济区内各地的司法协作制度,建立经济区利益补偿和共享制度,完善协作立法信息交流与公开制度等五方面来构建关天经济区地方立法协作制度。

Construction of the Legislative Collaboration System of Guanzhong--Tianshui Economic Zone

The economic zone to legislation should be as a legal foundation of the construction of the Guanzhong--Tianshui economic zone in order to ensure the rapid development of the economic zone of Guanzhong--Tianshui. However, there are some problems during the implementation of the legislation of the economic zone such as the imperfection of the legal systems, insufficiency in practice and some dispute in legislative theory, which hinder the development of the integration of Guanzhong--Tianshui. The au- thor shows some measures to avoid above problems to establish the cooperation system of Guanzhong-- Tianshui economic zone from the construction of the union legislative system, building the cooperation mechanism of the law enforcement and justice in the economic zone, setting up the benefits compensation and sharing mechanism of the economic zone and perfecting the legislative information exchange and open- ing system, etc.
