国企风险责任与企业依法自治

在市场经济条件下,任何企业都有经营风险,国有企业也不例外。国企的经营风险,不能由政府承担;对国有大中型企业不宜实行承包经营制度,由企业家个人承担风险责任。解决的办法是将国有企业改革为新型的社会主义企业法人,使其实现依法自治,成为命运共同体,实现法人承担风险责任与自然人承担管理责任的统一。有限责任公司、股份公司的形式可以“拿来”,却不能照搬,应予以改造。

The Enterprises' Risk Responsibility and the Enterprises' Self-management According to the Law

In the market economy condition, every kind of company except the state-woned enterprises will take the risk of management. The risk should not be taken by the state-owned enterprises, in the large or medium-sized state-owned enterprises, contracting out system shoule be put into practice and let the enterprises undertaken the responsibility in person. The good solution is to make the state-owned enterprises self-managed according to the law.
