| 摘 要： | 我国民商法中规定了若干种法定优先购买权,同时又在《拍卖法》中规定了价高者得规则。显然,这二者是相互冲突的。由于法定优先购买权和价高者得规则关涉相关当事人的切身利益,故法定优先购买权能否在拍卖过程中适用以及如何行使便成为拍卖实践中亟待解决的问题。
