摘    要:本文通过比较美国土地发展权转让制度和中国土地用途管制制度及耕地指标交易等地方创新实践,指出在中国土地用途管制制度创新中,应借鉴美国土地发展权转让的经验,引入市场机制,重点关注土地发展权的界定、配置及价值确定、发展权市场的建立及发展权转让过程中的监督问题,对各方面的效应进行充分的分析及权衡取舍,努力形成更为合理、完善的新制度。

Abstract:This essay draws a comparison between the transfer of development rights in the United States and China’s land use regulation system, which demonstrates that learning from the experiences of America and finding a way for market mechanism into China’s land use regulation system are of vital importance in the policy innovation. In the designing of the new policy, there are some prime problems that should be carefully considered such as the definition, distribution and value of development rights, the establishment of development rights market and the supervision issue. Only with these issues elaborately studied, can we finally come up with a reasonable new regulation policy.
