市政公用事业特许经营权招标、拍卖中存在的问题及监管对策

招标、拍卖是我国市政公用事业特许权出让的法定形式,也是"最优"的公共资源配置方式。但实际操作中存在的缺乏以招标、拍卖方式出让的意识,投标中的竞争不足、拍卖中的过度竞争诸多问题却使这些"最优"特性难以实现。因此,应当通过对市政公用事业特许经营实施方案的审查、竞标者的资格审查、招标和拍卖程序的合法性审查,以及对拍卖中过度竞争的监管等手段加强对市政公用事业招标、拍卖的监管,以实现对公共资源的合法、科学的配置。

Problem existing in municipal public utility's special management right public bidding and auction and its countermeasure

Tender and auction are the legal forms to transfer the authentic use right of pubic affairs.They are still the "best way"to allocate the public resources.However this is hard to achieve because of many problems,such as the lack of the sense to transfer the use right in the way of tende and auction; inadquate competition in tender; excessive competion in auction; ect.Therefore,tender and auction of the useage of public affairs should be supervized through the examination of the authentic management implementation plans for the public affaris; the qualifications of competes; the vality of tender and auction procedure and the control of extensive competition during the auction.In doing so,the public resources could be legally,reasonably deposition.
