我国工业化进程中的社会性规制

我国工业化进程加快,经济快速增长加大了对环境与自然资源的破坏,发达国家的产业转移又加剧了这一态势的发展。我国环境立法日趋完善,但治理情况不容乐观。其深层次原因就是制度因素,制度创新是解决问题的根本途径。我国应从消除地方保护主义、理顺和改革体制入手,设立独立性较强的执法常设机构,杜绝政府失灵,加强环境规制;并将严格的环境规制与经济手段相结合,促进经济社会的可持续发展。我国劳动者和消费者安全和健康方面存在严重的问题,政府应完善和细化有关法律法规,加大执法力度。通过社会性规制,控制风险,保护公众的安全和健康,形成以人为本的社会氛围。

Social Regulations in the Course of China's Industrialization

China's rapid industrialization and fast economic growth have resulted in increasingly serious destruction to the environment and resources and such destruction has been worsened by the industrial transfer from developed countries.Although China's environmental legislations are more and more perfect,the environmental administration is far from optimistic.The root cause of such situation lies in the institutional elements and therefore institutional innovation is the fundamental approach to resolving this problem.Chinese government should set up independent standing law enforcement organizations to eliminate local protectionism and reform environment protection systems so that government malfunction can be conquered and sustainable economic and social development can be achieved by combining environmental regulations and economic means.There exist serious problems in safety and health of China's laborers and consumers so the government should improve relevant laws and regulations as well as strengthen the law enforcement efforts.Thus a "people's first" atmosphere can come into being by controlling risks and protecting public heath and safety.
