摘    要:土地属于"实物性财产",土地产权制度属于物权制度体系。土地是纯自然的产物,不是任何人的"产品",又属于"永久性财产",在社会主义条件下,所有权只宜公有——国有和集体所有,应该私有的是其用益物权。应区别土地作为生产要素(生产投入)和人类生存空间(消费占用)的不同。城乡居民住宅用地应当同土地市场脱钩。农用地宜设定为永久使用权。采矿用地宜从一般工商业用地中分出。

Abstract:The paper first discusses the nature of land and land property system respectively.It points out that land is the products of nature,and it is perpetual property.Under the socialist condition,the land ownership is only appropriate to state-owned and collectively-owned,while the usufruct rights should be privately owned.The paper goes on to discuss that the difference between the land as production factors(production input) and living space of human(depletion and occupation) should be distinguished;land use for urban residential buildings should be separated from land market;perpetual right of use is suitble to farmland,and the land use for mining should be separated from general land use of industry and commerce.
