论我国对外资银行的法律监管

在2006年底,中国履行加入世贸承诺,取消了对外资银行的一切非审慎性市场准入限制,外资银行进入中国市场的门槛被大大降低。这也要求处于社会主义初级阶段的中国对外资银行实施更加完善的法律监管,调和外资银行的"入侵",对中资银行进行保护。但如今我国对外资银行实行的法律监管还存在不少问题,本文力图从法律执行效力、法律监管内容、立法模式等方面分析并具体论述其法律监管措施的经验与不足,并提出相应的建议。

On Chinese legal supervision on foreign bank

Since the year 2006,China has cancelled all the unpolitic limits of foreign capital banks on entering the Chinese financial market.It doesn't only become much easier for them to enter China,faultless legal supervision also has to be taken to foreign capital banks.Legal supervision leads a way of harmonizing the "invasion" of foreign banks,and also protecting Chinese capital banks.But since the supervision seems not mature enough yet,there is much to do to improve the execution efficiency,category contents,and legislation mode.This passage just tries to point out the shortcomings in these fields,and to give out some advice.
