摘    要:普惠制的实施历时40余年,它已成为国际贸易中一项重要的法律制度,实施普惠制的法律文件构成WTO规则体系的组成部分。随着WTO体制的建立和贸易自由化进程的加速,更由于受国际金融危机和欧债危机的影响与冲击,WTO发达成员已先后公布与实施新普惠制方案,受惠条件明显提高甚至订入了附加条件的特惠条款,动摇了WTO体制下普惠制的非互惠与公平原则。可以预见,普惠制作为一项制度最终或将退出国际贸易舞台,而作为一种精神还将存续并扩展适用于WTO其他领域。

Abstract:The implementation of GSP has been more than 40 years.It has become an important legal system in international trade.The legal documents in implementing GSP compose a part of WTO rule system.With the establishment of the WTO Regime and speeding up step of trade liberalization,as well as by the influence or impact of international financial crisis and European debts crisis,WTO developed members have published and implemented GSP scheme in which the higher beneficiary requirements and extra requirements for special preferential clause are provided.These extra requirements have shaken the un-mutual beneficial and fair principles of GSP under the WTO regime.It can be predictable,as for a system,GSP may be withdraw from stage of international trade sooner or later.While as for a spirit,it will remain and expand applying to other fields in the WTO.
