经济逻辑理论与司法裁判研究

在司法裁判中，法官运用的逻辑分析工具范围已经扩展得很宽，所使用前提的选择和形成要立足于对事实的鉴别和对法律规则的解释。这种鉴别和解释首先就立足于某种价值判断。它涉及社会、道德、政治等多种因素的共同作用，而“效率优先、兼顾公平”作为市场经济的普遍法则，从市场经济的逻辑视角出发，效率、效益必然成为法律追逐的主要目标，对于司法裁判的结果会产生极大影响。

Theory of Economic Logic and Judicial Assize

In the judicial assize, the variety of logical analytical tools which the judge makes use of has expanded greatly. Antecedent choice and formation depend on identification of facts and explanation for legal regulations, which first of all are based on certain value assessment. The choice of a certain premise, up to some value assessment, has something to do with social, ethical and political factors. The universal rule of market economy is to give priority to efficiency with due consideration to equity and justice. Therefore, efficiency must be the main goal of legislation, which may influence the judicial assize results greatly.
