计算机网络著作权侵权刑事保护的比较研究

在互联网日益发展的今天,网上的侵权案件时有发生,网络的广泛传播使得著作权损失巨大并且严重扰乱了社会经济秩序.但是侵权人并非都以营利为目的,更多的是为了名誉,同时网络传播权又不在刑法的保护范围之内,因而无法追究其刑事责任.缺乏具体的侵犯网络环境下著作权的具体刑法立法规定、刑法对于侵犯著作权规定过于粗糙受到了我国学者的普遍关心.
