| 摘 要： | 我国现行法律对代表人诉讼规定得比较原则，缺乏可操作性，导致证券侵权群体诉讼案件中在权利登记、代表人诉讼制度、代表人推选制度等方面存在诸多缺陷。应完善关于证券侵权群体诉讼的立法规定，吸取集团诉讼制度和团体诉讼制度规定中的优点，并不断提高法官的业务素质。

| Abstract: | Our current legal provisions of representative lawsuit is principle, lack of maneuverability, leading securities litigation in the tort rights groups registered representative action system, representative selection of the system and there exist many drawbacks. Tort litigation groups so they should improve legislation, and taking class action litigation system and the community benefits provisions, and improve the professional quality of judges. |
