| 摘 要： | 本人的过错是否为表见代理的构成要件一直是有争议的问题，但不应认为这是民事归责。表见代理是超越本人过错与否的制度设计，关心的是足以造成代理误解的外观。所以，对表见代理的类型划分，应从以代理权为视角转到以本人行为为视角。

| Abstract: | Whether the principal's fault is the essence of agency by estoppel has been argued for a long time. First,this is not liability criterion. Secondly,agency by estoppel places its concentration on the exterior,failing to take into account the principal's fault. Thirdly,the type of agency by estoppel is the most important element. Designing the type should be based on the the principal's action,and not on the right of anency. |
