| 摘 要： | 从附随义务的产生、质的规定性及其适用范围分析，附随义务派生于诚实信用原则，以辅助实现给付利益为目的，具有不确定性和附随性，它存在于所有债的关系中。先合同义务与后合同义务不属于附随义务。
