| 摘 要： | 《食品安全法》第53条确立了我国食品召回制度的法律地位。然而，从制度层面上看，法律体系不够完备、监管体制弊端明显、监管机制尚未理顺、召回体系过于简陋，应从各方面予以完善。同时，新《食品召回管理规定》征求意见稿出台，论文将兼做述评。

| Abstract: | Legal Status of food recall System has been settled down on Artical 53 of the nation＇s food safety law. While,in terms of legal texts, problems that including deficiency of related regulations, top-down style of supervision, multi-layer system and infeasibility of recall system, should be mitigated at all levels. This dissertation is also researched in the new draft amendment of Adminitration of food recall in 2011. |
