摘    要:从《劳动合同法》的视角分析,高校教师聘任合同的法律性质应该是劳动合同。但高校教师聘任合同法律机制存在着缔结中双方地位的失衡、内容中权利义务失衡以及争议解决中公平与效率的失衡等问题。由此,可以从聘任合同签订时力量均衡的法律机制、聘任合同条款内容公平合理的法律机制、合同争议公正处理法律机制等方面加以完善。

Abstract:From the perspective of "labor contract law",the legal nature of college teachers appointment contract is labor contract.There exist many imbalances in college teachers appointment contract including imbalance of both status during the conclusion of the contract,of rights and obligations,of equity and efficiency in the dispute settlement.Legal mechanism should be perfected in the field of power balance when signing the contract,content of contract terms as well as fair dispute settlement.
