| 摘 要： | 近年来，我国作品虚构角色商品化权方面的纠纷越来越多，但我国立法上并未对此进行规定。本文试图阐明作品虚构角色商品化权概念，并结合我国的实际情况对现行法律保护作品虚构角色商品化权进行法律分析，进而对我国作品虚构角色商品化权的保护提出相应的立法建议。

| Abstract: | In recent years, The disputes on the merchandising rights of fictional characters had been more and more. But China did not conduct legislative provisions about them. This paper tries to clarify the concept of merchandising rights. Combined with the reality of our country, the paper analyzes the legal protection for the merchandising rights of fictional characters. Then the paper advances corresponding legislative proposals on the merchandising rights of fictional characters. |
