试论林权概念的修正

林权作为一个法律概念,在林业实践中具有十分重要的地位。但长期以来,法学理论一直对林权内涵没有给予准确的界定。文章以此为立论基础,运用实证和比较分析的方法,通过对现行林业法和不同类型林权进行分析,将林权界定为自然人、法人或者其他组织对森林、林木、林地依法享有的占用、使用、收益或者处分的权利,在类型上包括森林、林木、林地所有权和森林、林木、林地使用权。

Modification of the Forest Right Concept

Being a juristical concept,forest right plays an important role in forestry practice.However,for a long time,law theory has not given a clear definition for the connotation of forest ownership.The paper's argument foundation is the connotation of forest right.The paper uses demonstration and comparative analysis method to analyze the current forestry law and forest ownership of various types,and defines forest right as natural persons,juristic persons or other organizations' rights of possession,utilization,gaining or treatment on forest,timber and forest land.Concerning the types,it includes ownership right of forest,timber and forest land and use right of forest,timber and forest land.
