WTO框架下的全球贸易争端研究

作为WTO"皇冠上的明珠"的争端解决机制一直是保障多边贸易体制的正常运行的中流砥柱,在缓解、消除全球贸易摩擦与冲突中起到重要作用。然而随着特朗普政府引领的美国"强权主义"回归,挑战了WTO争端解决机制的权威性,对上诉机构的干扰致使上诉机构几近瘫痪。在此背景下本文在对1995-2019年WTO争端案件发展趋势详细分析的基础上,着重研究了特朗普执政以来全球以及中美之间的贸易争端案件。通过对案件和当前WTO争端解决机制发展的最新事态的分析,本文进一步剖析了当前全球贸易争端机制存在的问题以及我国的应对之策,以期能对我国贸易利益的保护有所助益。

Research on Global Trade Disputes under the WTO Framework

As the jewel in the crown of the WTO,dispute settlement mechanism is the foundation of the multilateral trading system,playing an important role in easing and eliminating global trade frictions and conflicts. However, with the return of US "Powerism" led by the Trump administration, dispute settlement mechanism’s authoritative has been challenged. Appellate body of WTO has paralysed because of the interference of America. In this context, on the basis of develop trends of WTO dispute cases from 1995 to 2019, the paper focuses on the detailed analysis of the global trade dispute cases, especially the characteristics of Sino-US trade friction cases during Trump’s administration. Through the analysis of the cases and the latest development of the current WTO dispute settlement mechanism, this paper further analyzes the existing problems of the current global trade dispute mechanism and China’s countermeasures, in the hope of contributing to the protection of China’s trade interests.
