| 摘 要： | 随着社会经济的不断发展,地理标志作为一项重要的知识产权日益受到各国的重视,但目前我国地理标志权和商标权间仍然存在冲突,在一定程度上阻碍了我国地理标志产业的长远发展。文章以目前我国地理标志权和商标权之间的冲突及其原因作为切入点,介绍国外的地理标志保护模式,并对我国地理标志权和商标权间冲突的解决提出自己的建议。

| Abstract: | With the continuous development of social economy, geographical indication as an important intellectual property rights has drawn increasing attention of the whole world. However the current conflict of right of trademark and geographical indication has, to some extent, hindered the long-term development of geographical indication industry in China. This paper takes the conflict and the reasons between right of trademark and geographical indication as the breakthrough point, introduces foreign geographical indication protection models, and proposes specific solutions on the conflict of right of trademark and geographical indication in China. |
