知识产权保护与技术创新困境研究

创新活动的增加会导致相应的知识产权保护的加强，但保护的加强并不导致创新活动的增加，相反，它可能抑制创新。专利保护尤为明显，由此产生的法定垄断从原创发明扩散、官司诉讼、研究工具与材料的公地悲剧等方面阻碍进一步的技术创新；专利的自我垄断效应从巨额前期投入、学习效应、协同效应、技术关联、消费者行为强化等诸方面阻碍进一步的技术创新；此外，保护规则的不当利用又加剧了技术创新困境。

A Research of the Predicament of Intellectual Property Protection and Technique Innovation

The increase of innovative activities will lead to the reinforcement of intellectual property protection,but the reinforcement of protection will not lead to the increase of innovative activities.On the contrary it may restrain innovation.Patent protection is especially like this and the legal monopoly deriving from this hinders further technique innovation from the aspects of invention diffusion,lawsuit,the tragedy of commons of researching tools and material;the self-monopoly effect of patent hinders further technique innovation from the aspects of large sum of investment in the prophase,learning effect,cooperative effect,technique correlation and consumer behavior reinforcement;Moreover,the improper application of protecting rules strengthens the predicament of technique innovation.
