限购令法律问题探究

摘    要:2010年,房地产限购令出台以后对市场交易造成了极大影响。本文认为限购今从性质上看主要是属于一种经济政策,它的内容已经构成了对《物权法》和《价格法》等法律制度的违背。另外,限购令作为一种抽象行政行为违反了行政法的比例原则,也过度干预了市场主体的自主交易行为,有必要将限购令纳入司法审查范围,加强对相关责任主体的规制。

Abstract:Since the House Purchase Restriction Order announced in 2010, it makes so great influence on markets transactions. This essay holds the opinion that the House Purchase Restriction Order is a kind of economic police in its nature, and it violates the regulations of Property Law and Price Law As one of an abstract administrative act, the House Purchase Restriction Order contradicts with the principle of proportionality in administrative law. It is necessary to regulate the order from the aspect of procedure and judicial supervision
