论农民土地财产权的保障

土地的财产属性和资源属性,决定了土地财产权不仅具有财产（经济）功能,还具有环境、生态、政治、社会等方面的功能。农民土地财产权的主体因素、客体因素以及价值因素的特殊性决定了农民土地财产权具有区别于一般财产权的特殊属性与功能。农民的土地财产权在过去受到极大的限制,改革开放以来,农民土地财产权的财产功能开始受到重视,但仍存在许多亟待解决的问题。对农民土地财产权的保障,关键在于静态的确权保障以及动态的权利变动保障。

We can find out from the historical research and present analytical investigation, that there was much restriction imposed on the peasant land property .Also many problems need to be solved urgently, although, the more attention to the peasant land property has been paid since the Reform and Open policy be carried out. We think the primacy point on the guarantee of peasant land property lies in safeguard of static state and trends.
