摘    要:知识经济时代,信息就是财富。雇员跳槽中带来的商业信息转移,会给原来的企业带来重大的商业损失。而劳动合同法使得员工跳槽的成本进一步降低。西方企业的成功实践告诉我们,中国企业在这一背景下,需要善用《劳动合同法》中的竞业限制条款,保护企业的商业秘密,维护市场公平竞争的秩序。

Abstract:In the knowledge-based economy period, information is wealth. The former companies have to take the business loss because of the economy information transferring that brought by employers' job-hopping. Besides, law of labor contract reduces the cost of job-hopping in another way. The successful examples of west companies tell that Chinese companies should use the employment restriction clauses properly to protect their business secrets and keep a fairly-competed order in the market.
