| 摘 要： | 消极诉讼观在当代中国农民中是非常普遍的。它既有传统诉讼文化的制约，又由农村社会现实状况决定，还受司法制度的缺陷影响。它的存在，妨碍农民自身权利的维护，损害司法权威，阻碍法律至上精神的形成。因此，必须通过开展普法教育、推进司法制度改革、挖掘传统诉讼文化的合理内核等途径，实现农民诉讼意识由消极诉讼观向健诉诉讼观的现代性转变。

| Abstract: | Passive litigation conception is very common within the contemporary Chinese peasant.It is caused by some reasons including the tradition litigation culture,the realistic status in the rural,the judiciary's drawback.It harms the peasant's rights and the judiciary's authority.It also hampers the development of the sainted law's spirit.So,we must develop the law popularization,reform the judiciary, excavate reasonable litigation character so as to achieve the transformation from passive litigation to healthy litigation. |
