电子书产业发展中的著作权问题

电子书产业发展中主要涉及作品数字化使用的许可授权及其许可使用费等著作权问题。电子书经营者可以通过出版社、报刊社的转授权和著作权集体管理组织的授权获得使用许可,在特殊情况下可以适用法定许可;许可使用费以适当为标准,理论上应当由当事人事先约定,但在我国由行业协会或行业主管部门制定统一标准可能是一个较好的选择。

The Issue of Copyright in Development of E-book Industry

E-book in the development of Industry mainly covers the authority permission and royalty of digital works in use.The operators of e-books can obtain the license by means of delegation of authority from publishers,newspapers and Copyright Collective Management Organization.In special circumstances a statutory permissiion can be applied.Royalties must be charged in an appropriate standard,theoretically,which should be appointed by the clients in advance.However,it may be a better choice to develop uniform standards in our country by industry associations or industry administration departments.
