| 摘 要： | 从相邻关系的立法目的来看,传统的相邻关系规范有适用或类推适用于小区相邻关系的价值基础,然而高层建筑基于其本身的结构特征和对传统的以地表为中心的土地利用方式的改变,使得小区区分所有建筑物的相邻关系表现出立体性的特征,并在规范内容上与传统的相邻关系相区别。

| Abstract: | The purpose of legislation about the neighboring right in a flat is similar to the adjacent relation, so the adjacent relation is applicable for a flat, but because of the structure of a flat and the different pattern of using the land, the character of the adjacent relation in condominium reveals the character of three-dimensional relation and it' s content is different from the adjacent relation. |
