摘    要:从产权理论的角度界定了物业管理权是物业产权不可分割的组成部分,列举了物业产权与管理权相背离所产生的诸多经济和社会问题,指出了科学构建北京市物业管理实施细则的重要性和迫切性;对正在制定中的北京市物业管理实施细则的具体内容提出了相应建议.

Abstract:This article, from the perspective of property right, defines the right of property management as an integral part of property right and examines numerous economic ane social problems resulting from the existing contradiction between the right of property and that of property management. Also highlighted are the importance and urgent need to construct the Implementation Measures of Property Management of Beijing Municipality rationally. While providing a positive analysis of the State Regulations on Property Management that went into effect in 2003, the article raises questions on the issues concerning the practicality and lawfulness of those laws and regulations which were promulgated for the purposes of implementing the above-mentioned State Regulations. The article concludes with nine specific and operable recommendations and suggestions to the Implementation Measures of Property Management of Beijing Municipality, which is still being drafted.
