职务科技成果转化收益配置中的权责规范化研究

摘    要:国家为激发科研人员积极性、进一步促进科技成果转化,为科研人员以及对转化有重要贡献的人员获得奖励及报酬提供了一系列法律支持。但是,由于国家及单位在职务科技成果转化收益配置中权责不清、规范化程度较低,使得收益的有效配置受到一定限制,有关奖励及报酬的激励作用未能得到有效发挥。科技成果转化收益配置优化需要以权责为核心的法治规范化为引导,国家应赋予科研机构及科研人员“更大自主权”,提高收益配置效率,促进科技成果转化。首先,需明确国家在其中的权力与责任;其次,应着力降低科研机构在正当行使“更大自主权”过程中可能承担的不当责任;最后,应在尊重权利发展规律的前提下赋予科研人员更大自主权。

Abstract:The ownership of the scientific and technological achievements is the point of the income distribution of transformation for stimulating the researchers' enthusiasm. The bold and specific action which have been taken to by the government is handicapped by the state-owned property management system, but some fundamental problems still remain. More effective measures have been adopting to allow "more autonomy" to scientific research institutions and researchers. As countries should bear the state responsibility for its illegal acts, reducing or removing the mishandling responsibilities of the scientific research institutions is also important, allowing "more autonomy" is the necessity of the way to respect the objective law.
