| 摘 要： | 建筑行业农民工权益保障程度，已经成为构建和谐社会的重要标志之一。目前建筑业农民工在身份平等权、劳动权、民主政治权等应然权力方面状况令人担忧。文章在分析建筑行业农民工上述应然权力状况存在缺陷的基础上，提出以改革建筑行业现行用工制度、发展劳务企业为核心，以改革二元户籍制度、加强行业教育培训、强化政府责任为配套措施。目的是改善建筑业农民工的权益保障状况，促进建筑行业整体良性发展，为构建和谐社会打下基础。
