论劳动债权保护的必要性

破产企业劳动债权的保护不仅关乎到企业职工自身的生存利益,更关乎着社会的和谐与稳定。从目前我国企业破产实践看,由于职工在企业中处于弱势地位,加之信息不对称等原因,致使劳动债权在企业破产分配中往往得不到有效地清偿,所以劳动债权的保护实为必要。基于社会政策的立法考量,我国的破产立法必须优先考虑保障破产企业职工的权益。同时,在法律全球化的背景下,对劳动债权的保护也要与国际规定接轨。

Protecting the labor-credit in bankrupt enterprises concerns not only the employees' own survival interests,but also the social harmony and stability.In reality,it is necessary to protect labor-credit as workers are in a weak position and have unclear information and labor credit can not be effectively paid off in the allocation of corporate bankruptcy.Based on considerations of legislation on social policy,the bankruptcy legislation must give priority to safeguard the rights and interests of workers.Meanwhile,in the context of legal globalization,the protection of labor-credit should be in line with international regulations.
