从立法上解决西部开发中环境资源保护与经济发展的冲突——基于可持续发展环境伦理观的思考

西部大开发必须遵循可持续发展的环境伦理观。可持续发展的环境伦理观使经济发展与环境保护的关系从相克到相生。法律手段是解决西部开发中环境保护与经济发展冲突，实现可持续发展的根本手段。现行环境资源法存在着立法主流理论不能与时俱进，有较多计划经济色彩，相关规定虚位等缺陷。在完善环境资源保护立法时，要坚持经济发展与环境资源保护相协调、依法有序开发、开发与节约并举、生态建设和污染防治并重、统筹兼顾、因地制宜、突出重点、分类指导、借鉴国外成功经验的原则，以市场经济为导向，把自然资源的开发、利用、保护全面纳入法制轨道，推进自然资源产权制度创新，建立自然资源产权流转制度，推行自然资源管理体制改革，重视科技创新作用的法律调整。

Resolve Conflict between Protection of Environment Resources and Economic Development in Development of West Regions from Lawmaking --In the Light of Sustainable Environment Moral Philosophies

The development of the West regions must keep on the environment moral philosophies of the sustainable development. It can keep economic devleopment and the environmental protection together. The law means is a solution to solve the conflict between protection of environment resources and economic development in the development of the west regions. The cause of current environment resources exits some drawbacks as the law- making main principle cann＇ t keep pace with the times, etc. At perfecting environment resources protection, lawmaking should insist economic development together with environment resources protection, ecosystem development should lay equal stress with pollution treatment. Guided by the market, we should promote property system innovations of natural resources, reform management system, etc.
