| 摘 要： | 唐律明文规定了司法回避制度.根据回避事由或回避主体的不同,中国古代司法回避主要分为籍贯回避、亲属回避、故旧回避、司法官之间的回避以及非审判官吏回避等种类.古代司法回避制度具有中华法系的特质,也回避不了其固有的历史局限性.

| Abstract: | Tang code has made explicit stipulations on the judicial avoidance system. According to the differences of cause or subject of avoidance, judicial challenge in ancient China mainly is mainly divided into avoidance for native place, relatives, old friends, judges as well as non -judges. Judicial avoidance in ancient China has the special characteristics of Chinese legal system, besides it could not avoid its inherent historical limitations. |
