| 摘 要： | 限制农村集体建设用地流转的政策取向已不符合生产力发展的要求，处于失效状态。市场经济条件下，农村集体建设用地流转的公共政策必须重新定位。集体建设用地流转的公共政策选择是建立健全集体建设用地流转的市场机制，促进土地市场发育。同时，基于市场失灵的客观存在，集体建设用地流转需要加强国家宏观调控与管理力度以消除市场失灵。而集体建设用地流转公共政策重新定位的关键在于政府职能的成功转变。
