| 摘 要： | 由于WTO争端解决的技术性和法律性日益强烈,专家意见受到了重视。专家组、上诉机构都可以发表或者接受专家意见。专家组拥有任命专家的权利,相关国际组织在其中发挥了重要作用。专家意见的作用在于解释事实,发表个人观点,本质上没有法律约束力,但它对案件的裁决具有影响力。有关专家意见的判断标准,可以依据所涉问题的实质法律标准、举证责任和审查标准予以分析。

| Abstract: | Since the WTO dispute settlement becomes more technical and has been legalized,expert advice in WTO dispute settlement is of great importance.During this process,the Panel,dispute parties and the Appellate Body may deliver or receive the expert advice.The panel has the power to appoint experts,with the cooperation of relevant international organizations.Expert advice is limited to the explanation of the facts,so is personal opinion and essentially non-binding,but may indirectly influence the results of the ... |
