| 摘 要： | 从国际航运实务的角度而言,无船承运业务早已包含在货代服务以及多式联运服务之中,《中华人民共和国海运条例》将无船承运人以及无船承运业务的概念引入到我国法律体系。明确了无船承运人充当第三方物流经营人时其法律特征及无船承运法律性质,并就我国无船承运业务中存在的法律问题及其对策进行几点探讨。

| Abstract: | Non-vessel Operating Common Carriers(NVOCC) has already been included in freight forwarding services and multimode transport services from the point of view of international shipping practices.The concepts of NVOCC and the business of NVOCC are introduced to our legal system by Regulations of the People's Republic of China on International Maritime Transportation.The legal characteristics of NVOCC acting as Third Party Logistics Operators(3PL) and the legal nature of NVOCC are clarified in this paper.And the existing legal issues in the business of NVOCC in our country and the corresponding solutions are discussed further. |
