取消设立许可:养老机构事中事后监管研究

依据2018年12月29日新修改的《中华人民共和国老年人权益保障法》有关取消养老机构设立许可、监管重心移至事中事后的改革新政,本文研究分权与监管的平衡。论述“放管服”改革过程中养老机构“宽进”和“严管”的政策机理,以及事中事后监管体系的结构性功能。剖析新规旧政转换过程中存在的监管盲区,强调通过“增量覆盖存量并且优化存量”的方法打破僵局,提出事中事后监管体系的实现路径:完善综合监管体系的组织架构,“责任清单”式的跨部门综合监管,以联合惩戒为核心的信用监管机制等。

Cancellation of Permission for Establishment:Research on In-event and After-event Regulation of Nursing Institutions for the Aged

According to the new policy ofcancelling the permission for establishment of nursing institutions for the aged and transferring emphasis of regulation to in-event and after-event control in the newly revised law of the People's Republic of China on the protection of the rights and interests of the elderly on December 29th 2018,this article conducts research on balance between decentralization of authority and regulation.It discusses the mechanism for the policies of"easy to get in"and"strict in regulation"of nursing institutions for the aged during the"simplifying administrative procedures,innovating regulations and providing efficient services"reform,and the structural functions of the in-event and after-event regulation system.In addition,it analyzes the blind zone for regulation during the conversion between new and old regulations and policies.Besides,it lays emphasis on breaking of deadlocks with the method of"strengthening covering and optimizing stocks.It proposes the realization path for the in-event and after-event regulation system:to improve the organizational structure of the comprehensive regulation system,implement the"list for responsibility"type trans-department comprehensive regulation,and adopt the credit regulation system with the core of punishment.
