社会转型时期疑难案例的制度性成因

疑难案例的大量存在已不能简单地归结为法律自身的问题。当法律规定的权利不能在现实生活中实现,违约者不能受法律制裁,权力者不依法办事,法律就没有威力,这样社会就处于一种“无法”状态。对正处在社会转型时期的中国,权力在运行过程中存在着大量的问题,如中央权力和地方权力存在张力而导致的矛盾;权力交叉重叠而导致的政出多门、互相冲突;权力部门和权力行使者行使权力过程的非市场化而产生的公共权力私有化;以及权利对权力在运行过程中缺乏有效监督。上述问题的存在是疑难案例存在的制度性原因,因而疑难案例的消解也将会是一个长期的过程。

The Systematic Reasons for Difficult Cases in a Peculiar Transitional Period

The existence of the multitude of difficulty cases cant be simply attributed to the law itself. When the rights endowed by law cant be deserved in practice, the law-breaker aren't punished, the power-owner dont exercise their duty, the law will lose its dignity. As a result, the society is in a state of being lawless. China, in a peculiar transitional period, is suffering from a wide range of issues such as the conflicts between the power by law and the beyond the law; the contradiction between the centralized power and the regional one; the disharmony resulting from the rights overlapping; the possession of the public power in one's own name caused by the right sections and right executors in the course of exerting the power; the lack of effective supervision, etc. The issues mentioned above are the systematic reasons why the difficult cases occur. Hence, it's a long way to go before such phenomena out of sight.
