信用证软条款的成因及风险防范措施探讨

随着国际贸易的日益发达,信用证是国际贸易结算中的地位与越来越重要。在交易中当事人为了保护自己的利益在信用证中加设一些对自己有利的条款,导致信用证软条款大量出现。软条款违反国际贸易交往的基本原则,破坏了公平的国际经济贸易交易习惯,给国际贸易带来一定负面影响。本文阐述信用证"软条款"的概念,列举了信用证软条款的常见类型,分析了信用证软条款产生的原因,从出口方的角度提出了信用证软条款的风险防范措施。

Causes for Soft Terms of Letter of Credit and the Risk Prevention Measures

With the increasing development of international trade, the role of letter of credit in international trade settlement becomes more important. In the transaction, in order to protect their own interests, the parties well add some favorable terms in letters of credit, resulting in large numbers of credit soft terms. Soft terms violate the basic principles of international trade relations, destroy the fair trading habits in international economic and trade, so they bring some negative impact on international trade. In this paper, the concept of ＂soft terms＂ in letters of credit is described, the common types of soft terms are listed, the causes are analyzed and the risk prevention measures are proposed from the perspective of exporters.
