| 摘 要： | 《劳动合同法》的制定和施行,使商业企业受到的约束大量增加。面对这一严酷的现实,如何做到依然更好地实现组织的战略目标,这是任何商业企业必须给予回答的一个极其重要的问题。从《劳动合同法》对用人的新约束及对用人单位合法权益保护的新规定看,在选择促进实现共赢目标的基础上,可以"既适应法律的约束,又能更好地实现组织的战略目标"的实现。

| Abstract: | The Establishment and implementation of "law on employment contracts" has made many constraints to commercial enterprises.How to better achieve the strategic goals of organization,it is a very important issue that any commercial enterprises need answer well.In this regard the paper propose to remove the constraints of law and enlcance the win-win consequence of the commercial enterprises by contract laws. |
