| 摘 要： | 《刑法修正案八》第22条将危险驾驶入刑,其中醉酒驾驶是危险驾驶的表现形式之一。这说明,立法者已采取了刑罚预防的方式来规范醉酒驾驶行为。然而,醉酒驾驶犯罪自身的行为特征决定了情境预防在预防此类犯罪中具有必要性和可行性。司法实践中,只有借鉴情境预防的相关理论,引入情境预防的相关措施,才能更好地预防醉酒驾驶犯罪。

| Abstract: | Offence of dangerous driving is regulated in the 8th Amendment of Criminal Law. This shows that the legislators have taken a penalty of prevention to regulate drunken driving behavior. However, characteristics of drunken driving behavior determine that it＇s necessary and feasible for situational crime prevention to prevent drunken driving offense. Judicial practice,the introduction of situational prevention measures in order to better prevention of drunk driving a crime. |
