论行政垄断的《反垄断法》规制

行政垄断严重阻碍了我国社会主义市场经济的发展和完善,影响我国在WTO更好地履行义务。鉴于我国目前的关于行政垄断的立法效力层次大多较低、缺乏应有的权威性特点,应尽快出台《反垄断法》,并在该法中就行政垄断的法律责任、反垄断执法机构的设置、诉权分配以及救济程序作出明确的规定。

On municipal monopolization's anti monopolization regulation

Administration monopolization is a great handicap to the development and improvement of socialistic marketing economy。And it also has an effects on our taking responsibility in WTO。Nowadays,the law on administration monopolization in our country lacks authority which it should have and it is also not effective enough。In view of these characteristics,Law against Monopolization is in great need。And this law should have clear rules on the responsibility of administration monopolization,the installment of its law enforcement organization,right and responsibility and the procedures of succor.
