摘    要:《物权法》提出住宅建设用地使用权期届满后自动续期的法律制度,但是并未对住宅建设用地使用权到期续期对象这一关键核心问题进行明确,致使学术界关于续期对象这一问题存在着住房套数、房屋面积以及住房套数和房屋面积相结合等诸多争议。在对已有学术观点进行评价的基础上,提出应以住宅实际分摊的土地使用权面积作为续期对象,并从权利性质与功能、可操作性和公平性3个角度论证该观点的科学性和合理性。鉴于家庭拥有多套住宅可能存在着建设用地使用权到期时点不统一、分布于多个不同城市、类型多种多样等诸多情形,深入探讨了以住宅实际分摊的土地使用权面积作为续期对象可能遇到的深层次问题,并针对性地提出了相应的对策与建议。

Abstract:Property Law proposes a legal system for the automatic renewal rules of the expiration of the right to use residential construction land,but the system doesn't define the core issue of the renewal objective,and thus,led to various controversies about renewal objectives,including the number of properties,housing area and the combination of both.The system also fails to make out the detailed provisions on whether the renewal should be paid,renewal period,renewal number,computational method for cost of renewal and renewal payment methods,etc.Moreover,the problem about the renewal objective of the right to use residential construction land has yet been unnoticed and controversial.The paper put forward that the renewal objective of the expiration of the right to use residential construction land should be the actual area of allocation land use right on the basis of evaluations of the existing academic perspectives,and also demonstrated the scientific quality and rationality of this viewpoint from three points:types and functions of right,operability and equity.Furthermore,considering that owners of many sets of residences might face different time points of the expiration of the right to use residential construction land,residential distribution of different cities,different kinds of residences,the paper had a deep discussion about problems of taking land area of dwelling houses as the renewal objective and put forward appropriate suggestions and countermeasures.
