论法经济学的发展、逻辑基础及其基本理论

法经济学是20世纪70年代以后西方经济学界也是法学界发展最快的流派之一,是20世纪后半期经济学界乃至法学界最重要的学术成果。本文通过对法经济学的产生根源、逻辑基础和若干基本理论的重新梳理和分析,探讨了法经济学发展的内在规律;同时,对法经济学的本土化和学科建设提出了相关的建议。

The Development, Logic Structure and Theory Base of Law and Economics

Law and Economics is one of the fastest-growing schools in both law and economic circles since 1970s. It is also one of the most important academic achievements in the two circles during the last half-century. By analyzing the roots, logic foundation and theories of the Law and Economics, this article summarizes up three logic principles; it also puts forward some suggestions on the localization and subject establishment of the Law and Economics.
